Privacy Policy

PACUSOFT S.A.S. (“Pacunex”) respects the privacy of people who interact with our services. This policy explains, in plain language, what data we process, what we use it for, with whom we share it and how you can exercise your rights.

Who we are

Pacunex is a software-as-a-service platform that allows businesses to operate artificial intelligence agents on their own data, connect with their customers through WhatsApp and other channels, and automate internal tasks.

We operate from Ecuador and serve customers across Latin America.

What data we process

If you visit our website or contact us

  • Basic browsing data (IP, browser, pages visited).
  • Data you send us through forms or WhatsApp: name, email, company, phone, message.

If your company is a customer

  • Data of the people who administer the account: name, email, role.
  • Usage data: access logs, settings.

If you interact with a company that uses Pacunex

  • Your WhatsApp phone number and the public name that the Meta WhatsApp Business platform shows.
  • The content of messages you exchange with that company.
  • When the company configures it, other data the company already has about you (for example, your invoice number).

In this last case, the data belongs to the company you’re interacting with, not to Pacunex. That company is the data controller; we just give them the technical tools.

What we use the data for

  • Respond to inquiries and requests you send us.
  • Create and maintain company accounts.
  • Allow businesses to operate their communications with their own customers.
  • Comply with legal and tax obligations in Ecuador.
  • Detect and prevent abuse of the service.

We do not use personal data to train artificial intelligence models. We do not sell personal data.

With whom we share it

We work with technology vendors that help us operate the service. The main ones are:

  • Meta Platforms, Inc. — provider of the WhatsApp Business messaging channel.
  • Cloud infrastructure providers — hosting and database.
  • AI model providers — for agent capabilities.
  • Email and payment providers — for operational notifications and billing.

Some of these providers operate infrastructure outside Ecuador. When data is transferred to other countries, we contractually require vendors to provide a level of protection equivalent to Ecuadorian law.

How long we keep it

We keep data for as long as needed to provide the service and meet legal obligations. When it’s no longer needed, we delete or anonymize it.

If your company has contracted Pacunex, the operational data is kept while the contract is active. Upon termination, we return the data to the company and delete it from our active systems within a reasonable period.

Your rights

You may exercise the following rights over your personal data:

  • Access the information we have about you.
  • Request correction if it’s wrong.
  • Request deletion.
  • Object to specific uses.
  • Request your data in a portable format.

If you interacted with a company that uses Pacunex (they replied on WhatsApp, sent you a campaign), that data belongs to that company. To exercise your rights, contact them directly. If you can’t locate them, write to privacidad@pacusoft.com and we’ll help.

If you contacted us directly or have an account in Pacunex, you exercise your rights by writing to privacidad@pacusoft.com. We respond within the timeframes set by Ecuadorian law.

Data deletion via Meta

If you interacted via WhatsApp and granted permissions through your Meta or Facebook account, you can revoke them from:

Facebook → Settings → Apps and websites → the app of the organization you interacted with

Upon revocation, Meta notifies us automatically and we delete the identifiable data linked to your Meta account. Procedure details at /legal/data-deletion.

Security

We apply reasonable technical and organizational measures to protect data: encrypted connections, encrypted storage of sensitive information, isolation between companies, access control and audit logs.

If we detect an incident affecting your data, we’ll notify you without undue delay when we’re obligated to do so.

Minors

Our service is intended for businesses and adults. We do not intentionally collect personal data from people under 15 years old (the age set by Ecuadorian law for autonomous consent by adolescents). If we detect this has happened by mistake, we delete the data.

Changes

We may update this policy. Material modifications are notified at least 30 days in advance. The “Last updated” date at the top indicates the current version.
